You

the individual accessing or using the Service, or the legal entity on whose behalf that individual is using it, if applicable.

We

the Very Soft team (referred to as either “we,” “us,” “developer,” or “our” in these Terms).

Application

the app named FitGPT, provided by us, which you can download onto electronic devices.

Service

the Application and all features, content, and online services provided through it.

Account

the optional FitGPT account you can create by signing in with Google.

FitGPT Pro

the paid subscription or lifetime purchase that unlocks premium features.

AI Features

features that use artificial intelligence to generate content, including the AI workout planner and the meal coach.

AI Credits

the units consumed when you use AI Features.

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use FitGPT. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. Purchases may only be made by, or with the permission of, someone of legal age to enter into a binding contract.

• Consult a professional first: Talk to a qualified healthcare professional before starting any exercise program or changing your diet, especially if you are pregnant, have an injury, a heart condition, high blood pressure, diabetes, an eating disorder, or any other medical condition.
• Listen to your body: Stop exercising immediately and seek medical attention if you feel pain, dizziness, faintness, shortness of breath, or chest discomfort.
• Estimates are approximate: BMI, calories burned, nutritional values, water targets, and progress figures are estimates and may not be accurate for you.
• Exercise at your own risk: Physical activity carries an inherent risk of injury. You are responsible for choosing exercises appropriate to your ability, using equipment safely, and exercising in a safe space. Telling the app about injuries or limitations helps tailor your plan, but it does not guarantee that a workout is safe for you.

You can use many parts of FitGPT without an account. Some features — including cloud backup and sync, AI Features, and saved recipes — require you to sign in with Google. When you create an Account, you agree to:

• Provide accurate information and keep it up to date.
• Keep access to your Google account secure, as it controls access to your FitGPT Account.
• Be responsible for all activity that happens under your Account.
• Notify us promptly if you believe your Account has been accessed without your permission.

If you use the app without an account, your data is stored only on your device. We cannot recover it if you uninstall the app, clear its data, or lose your device.

FitGPT offers AI Features, such as generating a personalized workout plan or suggesting healthy recipes from the ingredients you have. By using them, you acknowledge that:

• AI output can be wrong: Generated plans and recipes are produced automatically and may be inaccurate, incomplete, unsuitable for you, or inconsistent. Always review them with your own judgement before following them.
• Check recipes for allergens and dietary needs: The meal coach does not know every allergy, intolerance, or medical diet. You are responsible for verifying ingredients, allergens, portion sizes, and safe food handling and cooking.
• Your prompts are processed by a third-party AI provider: To produce a response, the information you submit and relevant profile details are sent through our servers to the AI model provider. Do not submit information you do not want processed in this way. See our Privacy Policy for details.
• Use of AI Features consumes AI Credits: Each request uses credits, and your available credits depend on your plan (see Section 6). If a request fails on our side, we aim to return the credit, but we do not guarantee any particular number of successful requests.
• We may change AI Features: We may change the underlying AI model, limits, or credit costs, or suspend AI Features, to maintain quality, safety, and cost sustainability.

Plans

FitGPT offers optional paid plans, which may include monthly and yearly auto-renewing subscriptions and a one-time lifetime purchase. The features, prices, and credit allowances of each plan are shown in the app before you buy and may vary by country. Prices include or exclude taxes as displayed by Google Play.

Billing through Google Play

All purchases are processed by Google Play and are subject to the Google Play Terms of Service. We use RevenueCat to verify purchases and manage your entitlements. We do not receive or store your payment card details.

Auto-renewal and cancellation

• Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the period ends.
• You can cancel at any time in Google Play → Profile → Payments & subscriptions → Subscriptions. Uninstalling the app or deleting your Account does not cancel a subscription.
• After cancellation, you keep FitGPT Pro until the end of the period you have already paid for.
• If a free trial or introductory price is offered, it will be described in the app. Unless you cancel before the trial ends, you will be charged the regular price when it ends.
• If we change a subscription price, Google Play will notify you in advance, as required, and you may cancel before the new price applies.

Lifetime purchase

A lifetime purchase grants FitGPT Pro for as long as we continue to offer and operate the Service. It is not a promise that the Service or any specific feature will be available forever. AI Features are metered with AI Credits for every plan, including lifetime, because each request has an ongoing cost to us.

Refunds

Refunds are handled by Google Play under its refund policies. You can request one through Google Play. Except where required by applicable law, payments are non-refundable, and we do not provide refunds or credits for partially used subscription periods.

AI Credits

• Credits included with a plan may be refreshed on a schedule (for example, daily). Unused included credits do not roll over unless the app says otherwise.
• Any credit packs you buy are added to your Account balance once Google Play confirms the purchase.
• AI Credits have no cash value. They cannot be sold, transferred to another Account, or exchanged for money, and they are not refundable except where required by law.
• AI Credits are tied to your Account. If your Account is deleted, any remaining credits are lost.

Restoring purchases

To use FitGPT Pro on another device, sign in with the same Google account on Google Play and in FitGPT, or use “Restore purchases” in the app. Purchases made while signed out are linked to your Account when you sign in.

Fitness Alarms are stopped by completing a short workout, with repetitions counted by your device’s camera. This feature is provided for motivation and convenience, and you agree that:

• Rep counting is automatic and may miscount. It does not assess whether your form is safe.
• You should not rely on FitGPT as your only alarm for anything time-critical, such as work shifts, flights, or taking medication. Alarms can be affected by device settings, battery optimization, operating system updates, silent modes, or a device restart.
• You will only perform alarm challenges when it is safe to do so, and you may always use the snooze or emergency escape options.

Camera images are processed only on your device and are never uploaded, as described in our Privacy Policy.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Copy, modify, reverse engineer, decompile, or disassemble the Application, except where the law expressly allows it.
• Interfere with or disrupt the Service, its servers, or its security, or attempt to access data or accounts that are not yours.
• Bypass or tamper with payment verification, entitlements, credit limits, or usage restrictions.
• Use automated tools, scripts, or bots to access the Service or AI Features, or resell access to them.
• Use AI Features to generate harmful, abusive, illegal, or misleading content, or to attempt to extract our prompts, keys, or systems.
• Post content on our feedback board that is unlawful, abusive, infringing, spam, or that contains other people’s personal information.

The Service, including its software, design, logos, text, workout plans, and other content created by us, is owned by Very Soft or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Application on devices you own or control, for your personal, non-commercial use.

Some exercise images and animations are provided by third-party content providers under their own licenses, with attribution shown in the app. Nothing in these Terms gives you ownership of, or the right to redistribute, any of this content.

You may use the workout plans and recipes generated for you for your own personal purposes.

You keep ownership of the information you enter into FitGPT. You grant us the permission we need to store, process, and display it in order to operate the Service for you, as described in our Privacy Policy.

If you send us feedback, ideas, bug reports, or feature requests — including through our feedback board at fitgpt.userjot.com — you agree that we may use them to improve the Service without any obligation or payment to you. Posts on the feedback board may be visible to other users.

The Service relies on third-party services, including Google (sign-in and Google Play), Supabase (authentication and data storage), RevenueCat (purchase management), an AI model provider, and UserJot (feedback). Your use of those services may also be subject to their own terms and policies. We are not responsible for third-party services, websites, or content that we do not control.

We may update, change, or remove features of the Service at any time, and some updates may be required to keep using it. We aim to keep FitGPT available and reliable, but we do not guarantee that it will be uninterrupted, error-free, or available in every country or on every device. Features that need an internet connection will not work offline.

You may stop using FitGPT at any time. You can delete your Account in Account Settings. Deletion takes effect 30 days after your request, and you can cancel it during that period. After that, your Account and associated data are permanently deleted. Remember to cancel any active subscription in Google Play separately.

We may suspend or terminate your access to the Service, or to specific features such as AI Features, if you materially breach these Terms, misuse the Service, commit fraud or payment abuse, or if we are required to do so by law. Where reasonable, we will tell you why. Sections that by their nature should survive termination, including Sections 3, 9, 14, 15, and 16, will continue to apply.

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service, or any content generated by AI Features, will meet your requirements or achieve any particular fitness, weight, or health result.

To the fullest extent permitted by law, Very Soft and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, or for any personal injury or health problems arising from exercises, meals, or advice you choose to follow, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve (12) months before the claim arose, or USD 50.

Some jurisdictions do not allow certain warranties to be excluded or liability to be limited, so some of the above may not apply to you. Nothing in these Terms limits any rights you have as a consumer that cannot be waived under applicable law, or our liability for death or personal injury caused by our negligence, or for fraud.

To the extent permitted by law, you agree to indemnify and hold harmless Very Soft from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or of any law or third-party rights.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page and, where the changes are significant, notify you within the app. By continuing to use the Service after changes take effect, you accept the updated Terms. If you do not agree, please stop using the Service and cancel any subscription.

These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law rules. This does not deprive you of the protection of mandatory consumer laws in the country where you live. Before starting any formal dispute, please contact us so that we can try to resolve the issue informally.

If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce any right is not a waiver of that right. You may not transfer your rights under these Terms without our consent, and we may transfer ours as part of a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.
